License

The Digital Content (as defined in our terms and conditions) remains the property of Divergent Sound Ltd, (Collectively, “Licensor”) and is licensed to you as the original end-user (“Licensee”), for use subject to the provisions below. All rights not expressly granted herein are reserved exclusively by Licensor.

Licensor or Divergent Sound Ltd may revoke a license granted to you in respect of Digital Content if you breach any of the below license terms or our terms and conditions.

License Agreement for audio loops, samples, and presets (the “Sounds”):

  1. The Sounds in these sample packs are licensed, not sold, to you to be reproduced within your original musical compositions only. 
  2. This license is granted for a single user only (and is given on a worldwide basis). The license is non-exclusive and is granted for the full period of copyright protection for the Sounds. 
  3. The right to use the Sounds is granted only to the Licensee and is NOT transferable. This license expressly forbids resale, relicensing or other distribution of the Sounds, either as they exist or any modification thereof. 
  4. The Licensee MAY NOT sell, duplicate, trade, loan, rent, lease, assign, transfer, upload to or download from any shared server space, time-sharing service bureau operation or computer/sampler network all or any of the Sounds to another user, or for use in any competitive product.
  5. The Licensee MAY use the Sounds in combination with other sounds in music productions (which include soundtracks such as films, video productions, radio/TV programs or commercials, computer games and multimedia presentations, library music), public performances, and other reasonable musical purposes within musical compositions.
  6. The Licensee MAY NOT use the Sounds in isolation as sound effects or as loops (i.e. a sequence of musical events), as loops or within any competitive products that are sold, relicensed, or redistributed to third parties such as Soundbanks, Samplepacks, Preset libraries, etc. In these scenarios the Licensee must arrange an extension with Divergent Sound Ltd.
  7. The Licensee MAY NOT use the Sounds in isolation or in combination with other sounds in music productions for the advertising or marketing of competitive products, including within preview songs, software demonstrations and product videos. In these scenarios the Licensee must arrange an extension with Divergent Sound Ltd.
  8. The usage of the Sounds, including but not limited to AI voice modelling, as a data set for training AI models is strictly prohibited without obtaining explicit written permission from Divergent Sound Ltd. Any unauthorised use will constitute a breach of this agreement and may result in legal action.
  9. Opening or using these products constitutes your acceptance of these terms.
